New Formula For Meal and Rest Break Premium Payments - California
On July 15, 2021, the California Supreme Court issued a decision that will increase California employers’ potential liability for missed meals, rest, and recovery breaks. In Ferra v. Loews Hollywood Hotel, LLC, the court unanimously held that employers must pay premium payments to employees for missed meals, rest, and recovery breaks at the employee’s “regular rate of pay” instead of their base hourly rate, as many employers were doing.
The regular rate of pay may be higher than the base hourly rate because the regular rate of pay must include all non-discretionary incentive payments such as bonuses and commissions. Moreover, because the court’s decision applies retroactively, the court created exposure for California employers that acted in good faith trying to comply with the law by paying premium pay at the base hourly rate.
Employers must include all non-discretionary payments such as bonuses, piece rate, commissions, shift differentials, or other non-discretionary incentive pay in calculating the additional hour of pay for meal and rest period premium payments.
To assist with compliance with this new regulation, we created a California-specific Transaction Type which is added to time entry on payout following the above rules, or keyword logic to pick up a client-created transaction type that follows the above rules. E.g. "Premium Pay," "Meal & Break Premium", etc.
The enhancement adds a new transaction type called California Premium. Hours on this transaction type are included in the calculation of overtime and weighted. Otherwise today only Regular transactions are looked at.

This is the recommended process and copies all the supplier properties from one supplier to the new one. Because Greenshades properties must be distinct per supplier name, we are removing the ability to copy these properties, thereby avoiding potential issues with filing.
